Article 15 Communication to the ICC Office of the Prosecutor on the Comoros Situation

On 19 November 2019, Dov Jacobs submitted a communication to the Office of the Prosecutor of the International Criminal Court, inviting her to confirm her decision not to open an investigation in the situation of Comoros.


A summary of the communication can be found here, on the 9 Bedford Row website, where it is particularly noted that, in addition to the issue of gravity, which is at the centre of the upcoming review decision, "the submission raises the question whether the flagging of the Mavi Marmara in Comoros a mere few weeks before the incident could be an indication of the absence of genuine link between Comoros and the vessel, and what consequences this could have on the exercise of territorial jurisdiction by the Court. Dr. Jacobs also questions whether the referral of one incident can truly be considered a “situation” under the Rome Statute".
